Policies

Everything families should know about classes, billing, safety, and participation at Mountain Peak Athletics. Please read carefully before enrolling.

SMS & Privacy Policy

Mountain Peak Athletics (“MPA,” “we,” “us,” or “our”) respects your privacy and is committed to protecting the personal information you share with us. This policy explains how we collect, use, disclose, and safeguard your information when you visit our website, register for our programs, attend our events, or communicate with us by email, phone, or SMS text message. By using our services or providing your information to us, you agree to the practices described here.

Information We Collect

Personal information you provide directly:

  • Name, address, email, and phone number
  • Athlete’s name, date of birth, and emergency contact information
  • Parent or guardian contact details (for minor athletes)
  • Payment and billing information
  • Medical or health information relevant to participation (e.g., allergies, injuries, physician clearance)
  • Photos or video taken at practices, competitions, or events
  • Communications you send us (emails, texts, form submissions)

We also collect website usage data automatically (IP address, browser type, device identifiers, cookies) and may receive information from third parties such as payment processors, registration platforms, and social media when you interact with our pages.

How We Use Your Information

  • Register athletes and administer classes, teams, camps, and competitions
  • Process payments and manage accounts
  • Communicate about schedules, events, billing, safety updates, and program changes
  • Send marketing communications, including SMS/text message marketing (only with your consent)
  • Ensure athlete safety and provide appropriate supervision and medical response
  • Improve our programs, website, and customer service, and comply with legal obligations

SMS / Text Message Marketing

Consent. By providing your mobile phone number and opting in, you expressly consent to receive recurring automated marketing and informational text messages from Mountain Peak Athletics. Consent is not a condition of purchase or participation in any program.

Message types. Messages may include promotions, event reminders, registration deadlines, schedule changes, weather/closure alerts, and other program-related communications.

Message frequency. Message frequency varies. Message and data rates may apply depending on your mobile carrier plan.

Opting out. You may opt out at any time by replying STOP to any text message from us. You will receive a confirmation message, after which you will no longer receive marketing texts. You may also opt out by emailing info@mountainpeakathletics.com.

Help. For assistance, reply HELP to any of our text messages or contact us at info@mountainpeakathletics.com.

Carriers. Carriers are not liable for delayed or undelivered messages.

No sharing of mobile data for marketing. We do not sell, rent, or share mobile phone numbers or SMS opt-in data with third parties or affiliates for their marketing purposes. Mobile information will only be shared with service providers that help us deliver our text messaging program, and those providers are contractually prohibited from using the information for any other purpose.

Sharing, Children’s Privacy & Your Rights

We share information only as needed to operate our business — with service providers under confidentiality obligations, event organizers and governing bodies for competition registration, medical or emergency personnel when responding to an injury, and as required by law. We do not sell your personal information.

Many of our athletes are minors. We collect information about children only with the consent of a parent or legal guardian, in accordance with COPPA. Parents may review, update, or request deletion of their child’s information by contacting us. You may also opt out of marketing emails (use the unsubscribe link) or SMS (reply STOP) at any time. Make-Up Class Policy

To maintain safe class sizes and appropriate coach-to-athlete ratios, MPA does not guarantee make-up classes for missed practices or classes. Please note:

  • Missed classes will not be prorated or refunded
  • No refunds are provided for absences, vacations, illness, or scheduled facility closures/holidays
  • Make-up classes, if offered, are at the discretion of MPA and based on class availability
  • Team practices, camps, clinics, evaluations, and special events are not eligible for make-ups unless otherwise stated

Withdrawal / Drop Procedure

If you wish to withdraw your athlete from a class or ongoing program, Mountain Peak Athletics requires written notice. Accepted forms of written notice include:

  • Email
  • Written letter
  • Front desk submission

Verbal notification through athletes, coaches, or other parents will not be accepted as an official withdrawal notice.

Important billing information: Families remain financially responsible for tuition and fees until written notice is received by MPA. A 30-day written notice is required to withdraw from recurring classes or memberships. If an athlete stops attending without notification:

  • Tuition will continue to be charged during the 30-day notice period
  • The athlete’s spot may continue to be reserved in class
  • Fees remain due regardless of attendance

This policy allows MPA to maintain consistent class sizes and staffing for all athletes.

Athlete Attire Policy

Athletes should arrive dressed appropriately and ready for activity.

Recommended attire:

  • Athletic shorts, leggings, spandex, or fitted athletic wear
  • T-shirts or athletic tops
  • Leotards or cheer practice wear
  • Cheer shoes or approved athletic footwear

For safety reasons:

  • No dangling jewelry or hoop earrings
  • No gum or candy during classes/practices
  • Hair must be secured away from the face
  • Large bows or bulky hair accessories should not be worn during tumbling or stunting activities
  • Fingernails should be kept short for stunt safety

Please leave valuables and jewelry at home whenever possible. Mountain Peak Athletics is not responsible for lost, stolen, or damaged personal items. All belongings should be clearly labeled with the athlete’s name.

Arrival & Pick-Up Policy

Athletes should arrive approximately 5 minutes before their scheduled class or practice time. Please do not drop athletes off excessively early unless approved by staff. For athlete safety:

  • Athletes may not enter the facility without a coach or staff member present
  • Parents/guardians should pick athletes up promptly at the scheduled end time
  • If you are running late, please contact MPA as soon as possible

Athletes should remain inside the building until their ride arrives. Parents are encouraged to escort younger athletes to and from the facility. During busy practice times, parking areas may become crowded — please drive slowly and carefully and remain aware of young athletes and families in the area.

Closed Practice Policy

At Mountain Peak Athletics, athlete safety, focus, and a positive training environment are our top priorities.

Recreation Classes

Parents/guardians are welcome to stay and observe during an athlete’s first two practices/classes. After that, recreation practices become closed to all spectators. Parents and guardians are invited back into the facility during the last 10 minutes of class for athlete pick-up, questions, and to briefly observe progress.

Sideline & Competition Teams

All sideline and competition team practices are considered fully closed practices. This policy helps:

  • Minimize distractions
  • Improve athlete focus and coach communication
  • Maintain a safe training environment
  • Encourage athlete independence and confidence

Coaches may occasionally invite families to observe specific practices, performances, or showcase days at their discretion. Parents/guardians are welcome to enter during the final 10 minutes of practice for pick-up and brief communication with staff if needed.

Photo & Media Release Policy

By participating in programs, classes, camps, clinics, events, or team activities through Mountain Peak Athletics (MPA), parents/guardians grant permission for MPA staff and coaches to photograph, record, or film athletes for promotional, educational, and informational purposes. Photos and videos may be taken by any authorized MPA coach, staff member, or representative during practices, classes, competitions, performances, camps, events, or other program activities. These images and recordings may be used in:

  • Social media posts
  • Marketing materials
  • Website content
  • Flyers and advertisements
  • Team graphics and promotional videos
  • Event recaps and program highlights

Athlete names may occasionally be used in connection with photos or achievements unless otherwise requested in writing. No compensation will be provided for the use of photos or video recordings. Mountain Peak Athletics will never knowingly use media in a manner that is inappropriate, unsafe, or disrespectful to athletes or families. Families who do not wish for their athlete to appear in photos or media materials must submit a written opt-out request to MPA prior to participation.

Acknowledgment of Risk & Release of Liability

As the parent or legal guardian of the participating athlete(s), I give permission for my athlete(s) to participate in programs, classes, practices, camps, clinics, competitions, open gyms, performances, and related activities offered through Mountain Peak Athletics (MPA).

I understand and acknowledge that cheerleading, tumbling, stunting, dance, conditioning, trampoline activities, pyramids, jumps, strength training, and other athletic activities involve inherent risks of injury. These risks may include, but are not limited to:

  • Falls
  • Collisions
  • Improper landings
  • Physical contact with other participants
  • Equipment-related injuries
  • Sprains, fractures, head injuries, spinal injuries, permanent disability, or death

I understand that participation in any physical activity carries risk, even when safety procedures, instruction, spotting, and supervision are provided. I acknowledge that Mountain Peak Athletics, its owners, directors, coaches, staff members, volunteers, contractors, affiliated organizations, facility owners, and program partners strive to provide a safe environment for all athletes.

In consideration for being allowed to participate in MPA programs and use MPA facilities, I voluntarily assume all risks associated with participation and agree to release, waive, discharge, and covenant not to sue Mountain Peak Athletics (MPA), its owners, coaches, staff, volunteers, contractors, affiliated organizations, facility owners, and program partners from any and all liability, claims, demands, injuries, damages, losses, or causes of action arising from participation in any MPA activity, except in cases of gross negligence or intentional misconduct as prohibited by law.

I understand that this agreement applies to all current and future participation in Mountain Peak Athletics activities unless revoked in writing.

Payment & Autopay Policy

By enrolling in classes, camps, clinics, lessons, team programs, or other services through Mountain Peak Athletics (MPA), you represent and warrant that all payment information provided — including credit card or bank account (ACH) information — is accurate, current, and authorized for use. You agree that:

  • All charges incurred will be honored by your financial institution or credit card provider
  • You are responsible for payment of all tuition, fees, registrations, penalties, and applicable taxes associated with your athlete’s enrollment
  • MPA may charge the payment method on file for scheduled tuition, memberships, late fees, competition fees, or other authorized charges

If autopay or online payment information is provided, you authorize Mountain Peak Athletics to process recurring payments using the payment method on file.

Billing & Withdrawal

A written 30-day notice is required to withdraw from recurring classes, memberships, or ongoing programs. Families remain financially responsible for all tuition and fees during the 30-day notice period, regardless of attendance. Non-attendance does not automatically withdraw an athlete from a class or program. Withdrawal requests must be submitted in writing to MPA.

Returned Payments & Chargebacks

Returned payments, declined cards, failed ACH drafts, or disputed charges may result in:

  • Late fees or returned payment fees
  • Suspension of athlete participation
  • Loss of enrollment or team placement
  • Collection activity or legal action if necessary

Initiating a chargeback or payment dispute through your bank or credit card provider without first contacting MPA to resolve the matter may be considered a breach of this agreement and could result in termination of current and future services. Mountain Peak Athletics reserves the right to refuse or discontinue services for accounts with unpaid balances.
